Installer fined £5,000 for fake
‘Bygone’ claim

Masterframe has revealed today how a company was fined £5,000 for falsely claiming to be using its Bygone Collection windows and doors – the third time the fabricator has had to defend its brand integrity in this way.

In a letter to The Glazine (read here), MD Alan Burgess said the company was even using genuine Bygone literature but, he continues: “When the homeowner realised the difference in quality and turned to us, we took the company to court, acting on behalf of the homeowner and Bygone Collection installers who they were pretending to be.

“The guilty party was fined over £5,000 plus 100 hours unpaid community work. Rip-offs like this give our industry (and them) a bad name.”

Masterframe also confirmed that the case, prosecuted on behalf of Lancashire County Trading Standards, was the third time the company has had to take action over intellectual property fraud.

Alan concluded: “As an industry, we need a flow of innovative ideas and new products to help us take advantage of new opportunities and expand the market. But companies are not going to continue investing their time, efforts and money if they don’t get a return.” Lancashire Trading Standards added that the trader had first been summonsed in 2015 but was at large for almost three years before being arrested earlier this year.

After pleading guilty to fraud, he was given a 161-day suspended prison sentence and ordered to carry out 100 hours of unpaid community service and pay more than £5,000 in costs and compensation.
