Enforcement Notice served on persistent TPS cold-caller

A Swansea installation company went on cold-calling TPS-registered consumers even after being warned by the Information Commissioner’s Office and had not even downloaded a recent copy of the TPS Register, the ICO said this week.
Issuing an Enforcement Notice against Horizon Windows Ltd of Pontardawe, the Commissioner said the company made 104 unsolicited calls to TPS numbers in the year to January 2017. But the notice added that additional enquiries revealed that complaints have continued since that time.
It notes that: “In particular, a further four complaints have been made to the Commissioner’s online reporting tool and 21 to the TPS, which would suggest that Horizon Windows are not taking their responsibilities seriously,” and continues that the company had not downloaded a copy of the TPS register since February 2017 “which would indicate that they are not effectively screening numbers against the most up to date list.”
The Commissioner concluded that a notice would be appropriate because: “the contravention is serious in terms of the volume and continuing nature of the complaints.”
